The following terms and conditions of service apply to any artwork or portraits commissioned through Elle Jay Pawtraits. Please ensure you have read them before submitting an order.

Copyright

Elle Jay Pawtraits retains any and all copyright claim on all portraits produced, this includes all reproduction and publishing rights. You are not permitted to use the images contained within this website, and artwork must not be copied, reproduced or published in any format without the prior express permission of Lindsey Jarvis at Elle Jay Portraits. Upon submitting a commission order the client agrees that images of commissioned artwork and reference photographs may be used by Elle Jay Portraits for promotional purposes, reproduction prints for sale or any other purpose.

Payments

A deposit of approximately 33% of the total portrait cost is required to begin any commission order. See Pricing for actual costs. This deposit is non-refundable and secures your place in the wait list. Any delay in deposit payment may cause your order to move down the wait list.  

The balance will become due upon receipt and approval of a scanned proof of the completed commission. Portraits will only be shipped once the balance has been received in full. Debit and credit card payments are handled by Stripe and Paypal and clients have the choice of which to use.

Payments may be made in instalments in the period between the commencement of your portrait and shipping. Artwork is not shipped until the balance has been paid in full so this time period can be flexible. Please Contact to arrange this.

Cancellation

You have the right to cancel your order within 7 days of the date your order is received. Following this period, your deposit becomes non-refundable. If you choose to cancel your order after the first 7 days, your deposit will be retained to cover time and materials used. In this instance, any completed or partially completed artwork will be retained and may be sold in any form to another party to recover costs.

Prices

Prices for standard commission options are set as per the current published price list available here. For non-standard requests, a quote will be provided which will form part of these terms and conditions upon acceptance. No work will begin until a quote is accepted and a deposit paid.

Gift Vouchers

Gift vouchers/certificates are not redeemable for cash but may be used to purchase a portrait of higher value upon payment of the difference. See Gift Certificates for full terms and details.

Timescales

When an order is accepted, an estimated date of completion will be given. Whilst every effort will be made to meet this, it should not be regarded as a guarantee. Overall timescales are subject to a wait list, cancellation periods and approval times, and so cannot be guaranteed.

Reference Photos/Source Material

Any source material provided to the artist as a reference for a portrait commission should only be submitted if the client has or obtains permission from any copyright holder. This is of particular importance if third party source material is used. The onus is upon the client to obtain this and provide a copy to Elle Jay Pawtraits at the time of ordering.

Adjustments/Alterations

Client satisfaction is of utmost importance. With this in mind, minor adjustments can be made to portraits only prior to shipping. Once the proof has been sent to the client for approval, the client has the opportunity to request, within reason, any minor alterations free of charge. Where unforeseen changes which deviate from the agreed commission are requested additional fees may be incurred.

Delivery

Delivery will be made by insured courier service or Royal Mail Special Delivery. A delivery address will be requested once the portrait proof as been approved by the client and any address information provided on the order form will be used as the billing address only. Clients will be informed of intended delivery date, though should be aware that once in the hands of the carrier, Elle Jay Pawtraits cannot be held liable for any delays.

Any information provided in the order form is used only for the purpose of fulfilling the commission order. Details provided by clients will not be passed to any third parties. Following completion of the order, client information is only stored in compliance with GDPR requirements where follow-up may be required.No payment information is handled by Elle Jay Pawtraits. Payment data is fully encrypted and handled entirely by Paypal or Stripe, unless the client chooses to pay via bank transfer, at which point bank account details will be disclosed.
